Welcome to Together Games! The terms "we", "us" and "our" refer to Together Games. Together Games operates this shop and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a carefully curated shopping experience (the "Services"). Together Games is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referred to in this document (the "Terms of Service" or "Terms"), describe your rights and obligations when using the Services.

Please read these Terms of Service carefully, as they contain important information about your rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to comply with these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your country or province of residence and that you have given permission for any minor members of your household to use the Services on a device that you own, purchase or manage.

To use the Services, including accessing or browsing our online shops or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing details, payment information and shipping information. You represent and warrant that all information you provide in our shop is accurate, current and complete, and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account and for all credentials relating to activity on your account. You may not transfer, sell, assign or license the use of your account to any other person.

SECTION 2 - OUR PRODUCTS
We have made every effort to ensure an accurate presentation of the products and services we offer in our online shops. Please note, however, that the colours and appearance of products may differ from those displayed on your computer screen due to the type of device you use to access the shop, as well as your device settings and configuration.

We do not guarantee that the appearance and quality of any products or services purchased by you will meet your expectations or be the same as those presented or made available in our online shops.

All product descriptions may be changed at any time at our sole discretion, without prior notice. We reserve the right to discontinue any product at any time and may limit the quantity of products we offer to any person, geographic region or jurisdiction, as appropriate.

SECTION 3 - ORDERS
By placing an order, you make an offer to purchase. Together Games reserves the right to accept or reject your order for any reason, at its sole discretion. Your order will not be accepted until Together Games confirms its acceptance. Before accepting your order, we must receive and process your payment. Please check your order carefully before placing it, as Together Games may not be able to cancel it after it has been accepted. If we do not accept, amend or cancel an order, we will attempt to notify you by contacting the email address, billing address and/or telephone number provided when placing the order.

Your purchases are eligible for returns or exchanges only in accordance with our Returns Policy.

You represent and warrant that the products purchased by you are intended solely for personal or household use and are not intended for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price charged for a product or service will be the price in force at the time you place your order and will be stated in the order confirmation email. Unless expressly stated otherwise, the prices shown do not include VAT, shipping, handling, customs duty or import charges.

Prices shown in our online shops may differ from prices offered in physical shops or online shops operated by third parties. From time to time, we may offer promotions through the Services that may affect pricing and are subject to terms and conditions separate from these Terms.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made through our shops. You agree to promptly update your account and other information, including your email address, credit card numbers and expiry dates, so that we can complete your transaction and contact you when necessary.

SECTION 5 - SHIPPING AND DELIVERY
We are not responsible for shipping or delivery delays. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance or events beyond our control. Ownership and risk of loss pass to you when the products are handed over to the carrier.

SECTION 5a - PRE-ORDERS

1. What a pre-order is. Some products, marked "pre-order" on the product page and in the cart (currently the game Popcorn Sheep and its Polish edition Popcornowe Owce), can be ordered before they reach our warehouse. The seller is Bartosz Bilejczyk, ul. Sucha 5, 64-920 Piła, Poland, VAT ID PL1182221918, e-mail: hello@togethergames.eu. The sales contract is concluded when we confirm your order by e-mail. You pay the full price when you place the order. We do not take a deposit. The number of pre-order copies is limited; once they are gone, the product can no longer be ordered.

2. Shipping date. We ship pre-orders on 4 November 2026, the game's premiere day. The latest shipping date is 30 November 2026.

3. Delays. If we see that your order will not ship by 4 November 2026, we will e-mail you straight away with the new expected date. From then until your parcel ships, you can cancel your order by e-mailing hello@togethergames.eu. We will refund the full amount you paid, including delivery, within 3 business days. If your order has not shipped by 30 November 2026, you can cancel at any time on the same terms, even if you have not heard from us. This does not limit your statutory rights in case of late delivery.

4. Cancelling before shipping. Whether or not there is a delay, you can cancel a pre-order at any time before it ships, without giving a reason. We refund the full amount you paid, including delivery, within 3 business days, to the payment method used for the order.

5. Right of withdrawal. As a consumer, you have 14 days to withdraw from the contract without giving a reason. The period starts on the day you, or a person you name, receive the parcel. A pre-order does not shorten this period. How to return the game and how we refund you is set out in our Refund Policy.

6. Free stickers. Every pre-ordered copy (presale until 4 November 2026, 23:59 Polish time, CET) comes with free stickers. The stickers are a free extra: they do not change the price, and you do not need to return them if you withdraw from the contract.

7. Pre-order price. The pre-order price is 79.99 PLN including VAT (English edition shipped to other EU countries: 19.99 EUR including VAT). This is a pre-order price, not a discount from another price: the game has not been sold at a higher price before. After the premiere we plan to raise the price to 99.99 PLN (23.99 EUR). Prices include VAT. Delivery costs are shown in the cart before you place your order.

8. Precedence. For pre-orders, this section takes precedence over sections 3, 4 and 5. Nothing in these Terms limits the rights you have as a consumer under mandatory law, including the law of the EU country where you live.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video and audio materials, and their design, selection and arrangement, are the property of Together Games, its affiliates or licensors and are protected by patents, copyright and other intellectual property rights.

These Terms permit use of the Services solely for personal and non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any materials contained in the Services without our prior written consent.

The names, logos, product and service names, designs and advertising slogans of Together Games are trademarks of Together Games or its affiliates or licensors. You may not use such marks without the prior written permission of Together Games.

SECTION 7 - OPTIONAL TOOLS
You may access customer tools offered by third parties through the Services, which we do not monitor and over which we have no control or influence.

You acknowledge and agree that we make such tools available "as is" and "as available", without any warranties, representations or conditions and without any endorsement. We accept no liability arising from or related to your use of optional third-party tools. Any use by you of optional tools offered through the website is at your own risk and discretion.

SECTION 8 - EXTERNAL LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any external materials or websites that you choose to access. If you choose to leave the Services to access such third-party materials or websites, you do so at your own risk.

We are not responsible for any loss or damage related to your access to any external website or use of any products, services, resources or content on any external website.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Together Games is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchase transactions are made directly with Together Games. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Together Games, including any injury, damage or loss arising from the purchase of products and services. You expressly release Shopify and Shopify's affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Together Games.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you confirm that you have read this Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes personal information related to your access to and use of the Services in order to provide and improve the Services for your benefit. Information you submit to the Services will be transferred to and shared with Shopify and third parties, which may be located in a country other than your country of residence, in order to provide services to you.

SECTION 11 - FEEDBACK
If you submit, post, email or otherwise provide any ideas, suggestions, feedback, reviews, proposals, plans or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including commercial use.

You represent and warrant that: (i) you have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with submitting the Feedback; and (iii) your Feedback will comply with these Terms.

You agree that your Feedback will not infringe any third-party rights, including copyright, trademarks, privacy or other personal or proprietary rights. You are solely responsible for any Feedback you post and for its accuracy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally, the Services may contain information that includes typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice.

SECTION 13 - PROHIBITED USES
Access to and use of the Services are permitted solely for lawful purposes. You may not access or use the Services, directly or indirectly: (a) for any unlawful purpose or in bad faith; (b) in violation of any local laws, rules, regulations or orders; (c) by infringing or violating our intellectual property rights or the intellectual property rights of others; (d) by harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating or otherwise harming our employees or any other person; (e) by providing false or misleading information; (f) by sending any advertising or promotional material, including "junk mail", "chain letters", "spam" or any other similar solicitations; (g) by impersonating or attempting to impersonate another person or entity; or (h) by engaging in any other conduct that restricts or inhibits anyone's use of the Services or that may harm Together Games, Shopify or users of the Services.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, sell, resell or exploit any part of the Services; (c) collect or gather personal information of others; (d) engage in spamming, phishing or pharming; (e) use any robots, spiders, scraping or automated tools to access the Services; or (f) interfere with, bypass or circumvent the security or authorisation features of the Services. We reserve the right to suspend, disable or close your account at any time and without notice if we determine that you have breached any part of these Terms.

SECTION 14 - AGENTS
This section applies if you use services, permit, enable or instruct an Agent to access, use or interact with any Services. "Agent" means software or a service that takes autonomous or semi-autonomous actions on behalf of or at the instruction of any person or entity, without direct supervision.

No Agent may access, use or interact with the Services unless it identifies itself and acts in strict compliance with the requirements set out below. We may restrict, including through technical measures, whether and how an Agent accesses, uses and interacts with the Services.

Agents are required to: (i) state that a request comes from an Agent and disclose the name of the Agent; (ii) not conceal or withhold the fact that any access or interactions come from an Agent; (iii) answer truthfully any questions intended to determine whether interactions come from a human or a computer; (iv) not bypass or avoid any measures intended to block or control Agents' access to the Services.

SECTION 15 - TERMINATION
We have the right to terminate this agreement or prevent you from accessing the Services at our sole discretion at any time and without notice, and you will remain liable for all amounts due up to and including the date of termination.

SECTION 16 - WARRANTY DISCLAIMER
Information presented within or through the Services is made available for general purposes only. We do not guarantee the accuracy, completeness or usefulness of this information. Any reliance on such information is solely at your own risk.

Except where expressly stated by Together Games, the Services and all products offered through the Services are provided "as is" and "as available", without any warranties, representations or conditions, express or implied. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event shall Together Games, our partners, directors, managers, employees, affiliates, agents, contractors, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages, including but not limited to lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, related to the use of any Services or any products purchased through them.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Together Games, Shopify and our affiliates, partners, managers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities or claims due to any third party as a result of or in connection with (1) your breach of these Terms of Service, (2) your violation of any law or third-party rights, or (3) your access to and use of the Services.

SECTION 19 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms, with such determination not affecting the validity and enforceability of any remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this website or in relation to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.

SECTION 21 - ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt shall be void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

SECTION 22 - GOVERNING LAW
These Terms of Service and any separate agreements under which we provide the Services to you are governed by Polish law. Any disputes arising from these Terms shall be resolved by the courts having jurisdiction in accordance with the provisions of the Polish Code of Civil Procedure. Consumers are entitled to rights arising from mandatory provisions of Polish law, including the Polish Consumer Rights Act of 30 May 2014.

SECTION 23 - HEADINGS
The headings used in this document are for convenience only and shall not limit or otherwise affect the provisions of these Terms.

SECTION 24 - CHANGES TO THE TERMS OF SERVICE
You can review the current version of the Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, amend or replace any part of these Terms of Service by posting updates and changes on our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
